Rights and Responsibilities of Foreigners in Romania

Emergency Ordinance No. 194 of December 12, 2002 on the Regime of Foreigners in Romania. Article 3. Rights of Foreigners

(1) Foreigners who legally reside in Romania are entitled to the general protection of persons and property guaranteed by the Constitution and other laws, as well as the rights provided in international treaties to which Romania is a party.
(2) Foreigners legally present in Romania have the freedom to move about and establish their residence or, as the case may be, domicile anywhere on the territory of Romania.
(3) Foreigners legally residing in Romania who temporarily leave the Romanian state territory have the right to re-enter for the entire duration of the residence permit’s validity.
(4) Foreigners with residence or domicile in Romania are eligible for social protection measures from the state, under the same conditions as Romanian citizens.
(5) Foreigners to whom a document has been issued by the Foreigners Authority have the right to verify the personal data recorded in it and, when necessary, request corrections or removal of data that do not correspond to reality.
(6) Foreigners enrolled in all levels of education have unrestricted access to school and training activities in society.

Emergency Ordinance No. 194 of December 12, 2002 on the Regime of Foreigners in Romania. Article 4. Obligations of Foreigners

(1) During their stay in Romania, foreigners are obligated to respect Romanian legislation.
(2) Foreigners cannot organize political parties or other organizations or groups similar to them on Romanian territory. They also cannot be members of such entities, hold public positions, or initiate, organize, or participate in demonstrations or gatherings that disrupt public order or national security.
(3) Foreigners cannot finance political parties, organizations, groups, demonstrations, or gatherings mentioned in paragraph (2).
(4) Foreigners present on Romanian territory are required to adhere to the purpose for which they were granted the right to enter and, where applicable, remain on Romanian territory. They must not exceed the approved duration of their stay and must take all necessary steps to exit Romania before the expiration of this period.
(5) Foreigners entering or leaving the Romanian state territory are obliged to undergo control for crossing the state border in accordance with the law.
(6) Foreigners present on Romanian territory are obligated, under the conditions provided by law, to comply with inspections by police authorities and other competent public authorities.
